Abstract
This Law, consisting of 21 articles, aims to regulate competition and prevent monopolistic practices by investors, producers, traders, and other actors across productive, commercial, service, and economic activities that may distort domestic or international trade, hinder economic development, or harm society. Article 4 establishes the Competition Protection and Monopoly Prevention Council at the Ministry of Trade and Industry, headed by the Undersecretary of the Ministry for Commercial Affairs, responsible for collecting and updating economic data related to competition, conducting relevant studies, and coordinating with related bodies. It receives and reviews information on anti-competitive or monopolistic practices and takes appropriate legal action. It also cooperates with similar authorities to exchange information on competition enforcement. The Council (i) prohibits anti-competitive agreements and abuse of dominant position aimed at monopolization ; (ii) bans price manipulation, including price fixing, unfair pricing practices, and false pricing or product information; (iii) prohibits restrictions or manipulation of production and supply, including quotas, output limits, artificial scarcity or surplus, and unjustified refusal to supply goods; (iv) forbids collusion in competitive processes, including bid rigging, tender manipulation, and coordinated bidding behavior; (v) prohibits exclusionary practices that restrict market access or trade, including blocking entry, obstructing business activity, denial of products, non-dealing obligations, and hoarding; (vi) bans discriminatory treatment of similarly placed buyers or sellers; (vii) prohibits tying and conditional contracts requiring acceptance of unrelated goods or obligations. Authorized Council employees may inspect premises, review and retain documents, temporarily close non-cooperative establishments, and investigate suspected violations. The Ministry of Justice’s role is limited to training these officers. Violations are punishable by imprisonment or a fine.
