Abstract
The Law, which consists of 5 articles, aims to regulate matters relating to lands, increase the land supply and adjust the land price, as one of the main causes of social wealth.
The Act has been codified in line with the Principle 31 of the Iran Constitution, which consider appropriate accommodation principal right of each citizen, and in order to preserve and sustainable use of lands in the country
According to the Law, urban lands refers to the lands located in the legal borders of the cities and towns and Urban Abandoned Land refers to the urban land which does not have any history of construction and rehabilitation. All the urban abandoned land is owned by the government and government is obliged to provide a suitable alternative land for every individual in possession of ownership documents of these lands, if he/she can revive it in the specified period of time.
In certain circumstances, including establishment of the public welfare facilities or other urban plans, the owner of urban lands are obliged to sell their lands to the government or municipalities in exchange for fair price.
From the date of adaption of this Act, all lands owned by ministries, governmental institutions, public entities, public banks and armed forces shall be in disposal of the Ministry of Housing and Urban Development (which has been changed to the Ministry of Roads and Urban Development). Any manipulation in urban lands owned by government or municipalities and any transfer of their ownership through official or non-official documents are considered a crime and violators shall be punished. Any change in land use planning of the urban agricultural lands is only possible if it is carried out in accordance with provisions of this Act.
