Abstract
The present Act lays down environmental impact assessment requirements for certain projects and plans. It contains 38 articles divided into the following chapters: I. Objectives, scope, definitions, etc.; II. Administration, consultation and integrated procedures; III. Environmental impact assessment of plans; IV. Environmental impact assessment of projects; V. Licensing requirements; VI. Review of environmental impact assessments, exemptions and appeals; VII. Supervision and administrative fines; VIII. Various provisions. Annex I contains a list of projects that shall always be subject to an environmental impact assessment, as well as projects that require individual assessment according to the criteria laid down in Annex 2.
The Act applies to zoning plans; documents defining the policies for the granting of permits related to projects specified in Annex 1; and to projects listed in Annex 1. The objectives pursued by the Act are concerned with sustainable development; a healthy environment and environmental protection; efficiency in environmental impact assessments; and public participation in environmental impact assessment. The content of the environmental impact assessments shall cover the direct and indirect impact on: a) population and human health; b) biodiversity, with special emphasis on protected species and habitats; c) land, landscape, wilderness, geological formations, soil, water, air and climate; d) material values and cultural monuments; e) sensitivity of a project or plan for the risk of catastrophic accidents and natural disasters; f) the interplay of the factors listed in points a to e. The National Planning Agency shall be responsible for monitoring the implementation of this Act and regulations issued in accordance with it.
