Abstract
The present Directive lays down some amendments and addenda to Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment. Firstly it amends article 1 as regards the definition of the process of environmental impact assessment. Further amendments concern the factors that must be identified in such assessment, namely: (a) population and human health; (b) biodiversity, with particular attention to species and habitats protected under Directive 92/43/EEC and Directive 2009/147/EC; (c) land, soil, water, air and climate; (d) material assets, cultural heritage and the landscape; (e) the interaction between all these factors. Member States are required to lay down rules on penalties applicable to infringements of the national provisions adopted pursuant to this Directive; the penalties thus provided for must be effective, proportionate and dissuasive.
