Abstract
The main objective of this Act is to create conditions for the breeding of shellfish, set rules on activities and thus strengthen the economy and settlement in the country. In addition, the law aims to maintain biodiversity and nature conservation in shellfish farming. It applies to the cultivation of shellfish that takes place in salt water in Icelandic territory, and also to, among other things, reptiles, mantle animals and sea snails. It contains the following Chapters: I. Objectives, scope and definitions; II. Administration; III. Licensing, etc.; IV. Activities; V. Fees; VI. Various provisions; and VII. Regulatory authority, penalties, etc. Article 5 states that Executive may, if ecological or economic reasons so recommend, decide in accordance with this Act on the arrangement and division of cultivation areas along the country's shores. The Act further contains specific provisions on bans of shellfish farming in certain areas; the issuance of temporary experimental permits for shellfish farming in order to investigate whether the area is suitable for such breeding; the application and granting of breeding licenses; conditions of structures and equipments for shellfish farming; fees; penalties; etc. The Executive shall lay down further rules on the implementation of this Act in a regulation.
