Abstract
The objective of the present Act is to prevent trade in timber originating from illegal logging and the marketing of timber and timber products from such activities in Iceland. The Act contains 22 articles organized in the following chapters: I. Objectives, scope and definitions; II. Division of governmental tasks; III. System of due diligence and monitoring institutions; IV. General duties; V. Coercive measures etc.; VI. Penalties; VII. Regulation, implementation, and entry into force.
The Act applies to timber and timber products as defined in Regulation (EU) No. 995/2010 of the European Parliament and of the Council laying down the obligations of operators who place timber and timber products on the market. Operators placing timber and timber products on the internal market of the European Economic Area for the first time shall, on the basis of a systematic approach, take appropriate measures to ensure that timber from illegal logging and products from such timber are not placed on the market. A general prohibition is established to place timber and timber products from illegal logging on the market. When importing and marketing timber and timber products, operators must use the due diligence system mentioned in Article 8 to ensure that timber from illegal logging and products from such timber will not be placed on the market. The Act further regulates Monitoring Bodies (Articles 9 and 10), whose roles will be: a) to maintain and regularly evaluate the due diligence system mentioned in Article 8; b) to verify the operator's correct use of the due diligence system; and c) to take appropriate measures if the operator misuses the due diligence system and the misuse is serious or repeated.
