Abstract
The Act aims at preventing the use of substances that deplete the ozone layer and determine adverse effects on the environment. It regulates the different stages of collection, recycling and disposal of such substances, in compliance with the international agreements and the relevant Community legislation referred to in article 1. Moreover, the Act makes provision applicable to the production, consumption, importation, exportation, keeping, collection, recycling and placing on the market of the substances that deplete the ozone layer mentioned in tables A and B hereto. No authorization shall be granted in respect of installations where the use of the substances mentioned inn table A is envisaged. Chapter II of the Act deals with disposal and recycling. Article 5 determines the functions to be exercised by the National Agency for Environmental Protection (ANPA). The Ministry of the Environment shall plan and implement information and education campaigns as per article 11. Article 13 regards the monitoring of the levels of the ozone and ultraviolet radiation. In case of violation of the provisions hereby laid down, consumers’ associations as well as environmental protection associations are entitled to resort to the competent tribunal in order to obtain the seizure or destruction, as the case may be, of those products that have been manufactured or placed on the market unlawfully (art. 14).
