Abstract
The present Decree has been adopted in implementation of article 3, paragraph 3 of Act No. 549 of 1993 requiring the Ministry of the Environment to establish by decree the date until which the use of the substances referred to in table A therein shall be permitted.
Chapter I of the Decree concerns halon, whereas Chapter II is entirely devoted to chlorofluorocarbons. Article 2 prohibits the use of recovered, recycled or regenerated halon. The importation of such substances from third countries is forbidden too (art. 6). Paragraph 3 of the same article lays down particular exemptions from such prohibition. Halon may be reclaimed, recycled, regenerated or destined to destruction only by special authorized centres for the collection of halon. Such centres may be set up on the basis of special agreements between the Ministry of the Environment and the enterprises which use substances that deplete the ozone layer, as defined under article 6, paragraph 5 of Act No. 549 of 1993. The above-mentioned centres must report periodically to the Ministry the information specified under article 4 hereto. In compliance with article 5 of Regulation (EC) No. 2037/2000, hydro chlorofluorocarbons may replace halon in the applications listed out in Annex I to this Decree.
