Abstract
The Decree Law No. 153/2024, addresses urgent provisions aimed at environmental protection, streamlining evaluation and authorization procedures, promoting the circular economy, and implementing interventions related to the remediation of contaminated sites and hydrogeological instability. Enacted as a legislative measure to ensure the timely achievement of the objectives established under the National Recovery and Resilience Plan (PNRR) and the National Integrated Energy and Climate Plan (PNIEC), it reflects the necessity to provide regulatory clarity within strategic sectors. In particular, the law introduces modifications to existing environmental assessment procedures, prioritizing projects of national strategic interest, renewable energy developments, and infrastructure improvements. It stipulates specific criteria for the classification and evaluation of such projects, aiming to enhance efficiency while maintaining compliance with environmental safeguards. Furthermore, it sets forth provisions concerning the sustainability of soil and water resources, reinforcing mechanisms intended to mitigate environmental emergencies and ensure the systematic monitoring of related interventions. Additionally, the legislative text outlines measures to facilitate the simplification of processes for the remediation of contaminated sites, reinforcing the administrative capacity of relevant public authorities.
It specifies procedural adjustments designed to expedite approvals while maintaining adherence to environmental and regulatory standards. The Decree also emphasizes the integration of circular economy principles within legal frameworks, advancing commitments undertaken at the European and international levels concerning material and waste management. It incorporates provisions related to hydrocarbon exploration and extraction, balancing environmental concerns with strategic energy supply considerations. Provisions concerning public administration capacity-building further reinforce operational efficiency in sectors relevant to environmental and energy security policy. By instituting targeted regulatory modifications, the decree seeks to enhance procedural certainty, support national sustainability objectives, and facilitate investment in key sectors. It represents an effort to harmonize legal mandates with overarching environmental protection and economic development strategies.
