Decree of the Ministry of the Environment and Energy Security (“MASE”) N. 436/2023 (the “Agrivoltaic Decree”).

This Decree, implements article 14, paragraph 1, letter c), of Legislative Decree No. 199/2021, and contains criteria and methods to identify agrophotovoltaic systems of experimental nature entitled to receive an incentive established by the Decree, in line with the measures to support the planned investments from the PNRR. Beneficiaries are both farmers engaged in agrophotovoltaic activities or association of producers. Art. 5 and 6 identify criteria for the agrophotovoltaic plants and procedures to receive incentives, this include a registration process and participation to public tenders. Art. 7 and 8 lay down selection criteria to filter project applications and timeframe to implement projects once approved. Other provisions concern notification system, incentives erogation, reporting. The incentives referred to in this decree cannot be cumulated with other public incentives or schemes support however named intended for the same projects.
