Abstract
This decree has the objective of accelerating the country's sustainable growth path, introducing provisions on energy from renewable sources, in line with the European objectives of decarbonisation of the energy system by 2030 and complete decarbonisation by 2050. For the purposes above mentioned this Decree defines the tools, mechanisms, incentives and institutional, financial and legal framework necessary to achieve the objectives of increasing the share of energy from renewable sources by 2030, in implementation of Directive (EU) 2018/2001 and in compliance with the criteria established by law 22 April 2021, n. 53. This decree contains as well provisions necessary for the implementation of the measures of the National Recovery and Resilience Plan (hereinafter also: PNRR) regarding energy from renewable sources, in accordance with the National Integrated Plan for Energy and Climate (hereinafter also: PNIEC). Art. 3 establishes National targets. Title II identifies general principles, and other elements like tariffs, specific incentives mechanisms for support schemes and promotion tools, in particular: support schemes for the production of electricity from renewable sources; support schemes for the production of thermal energy from renewable sources, biomethane and technological and industrial development; provisions regarding implementation and coordination with the PNRR and allocation of proceeds from CO2 auctions; etc.
Title II provides for authorizations and administrative procedures concerning for instance solar power plants, offshore installations, biofuel. It also entails obligations and technical regulations, such as obligation to increase renewable thermal energy in energy supplies. Title III regulates renewables self-consumers and renewable energy communities and the methods of engaging with the energy system, district heating and cooling. Title V concerns energy from renewable sources in the transport sector; sustainability criteria are established in particular in relation for in relation to biofuels production. The provisions establish that biofuels, bioliquids and biomass fuels from agriculture must not be produced from raw materials obtained on land which has a high biodiversity value, i.e. land which in January 2008, or subsequently, was located in one of the situations indicated below, regardless of whether or not they have retained said situations: (a) primary forests and other woodland, i.e. forests and other woodland of native species, where there is no clearly visible sign of human activity and where ecological processes have not been significantly disturbed; b) forests with high biodiversity and other woodland rich in species and not degraded or whose high biodiversity has been recognized by the competent authority of the country in which the raw materials were grown, unless it is demonstrated that the production of the aforementioned raw materials did not interfere with those nature protection purposes. Moreover Title VI regulates access to information,for the protection of rare, threatened or endangered ecosystems or species recognized by international agreements or included in lists compiled by intergovernmental organizations or by the International Union for Conservation of Nature, subject to their recognition by the European Commission; d) without prejudice to any new criteria adopted by the European Commission, natural grassy land with high biodiversity having an area exceeding one hectare, i.e.: 1) grassy lands that would remain so in the absence of human interventions and which maintain the natural composition of the species as well as the ecological characteristics and processes; or 2) non-natural grassland, i.e. grassland which would cease to be such in the absence of human intervention and which is rich in species and not degraded and whose high biodiversity has been recognized by the competent authority of the country in which the raw material was cultivated unless it is demonstrated that harvesting the raw materials is necessary to preserve their status as highly biodiverse grassland. training and traceability.
