Abstract
The Decree of the President of the Council of Ministers (DPCM) implements further measures to cope with the epidemiological emergency from COVID-19, it replaces the provisions issued by DPCM 24 October and its provisions have effect between 6 November to 3 December. The DPCM is organised in 14 Articles and 25 Annexes containing several sector guidelines and relevant technical documents and related legal orders.
Art. 1 establishes a nationwide curfew between 10pm and 5am; health, work and other urgent motives are the only reasons that justify movements, and a self-certification is required. In any case, it is strongly recommended at any point of the day that persons do not leave their homes except for work, health or other urgent reasons or to engage in physical activity or to make use of any ongoing services. As required in previous DPCM commercial activities may continue as long as an interpersonal distance of 1 meter is ensured, entrances are regulated, and customers are not allowed to remain inside longer than the time needed to make a purchase; in addition the criteria under Annex 10 and containment measures under Annex 11 must be followed. Commercial activities in malls and markets are closed during weekends and holidays. To what concern food service activities (including cafes, restaurants, pubs, ice cream and pastry shops) continue to be allowed between 5:00am and 6:00pm and now the criteria established under Annex 10 must be respected. After 6:00pm, the consumption of food or beverages continues to be prohibited in spaces open to the public (whether indoors or outdoors). In Hotels and other accommodations food services activities are allowed just for the guests. Delivery services continue to be allowed. Takeaway services are now allowed until 10pm. Canteen and catering services are allowed, as well as food retailers in highways, hospitals and airports. Art. 1 ll) grants continuity of business and production in the agricultural and zootechnical sector and supply chain.
Art. 2 sets a mechanism that allows the Minister of Health, on weekly basis, through ad hoc Orders to identify regions that due to the high transmission risks and rates need to be classified under “scenario 3” (Orange Zones) as described under the document “Prevention and response to COVID-19: evolution of strategy and planning in the transition phase for the autumn-winter season” of 8 October 2020 (Annex 25). Art. 2, par. 4 establishes the further containment measures, limited to regions classified as “scenario 3" and these include: a) movement of people outside of those regions is not allowed unless health, work and other urgent motives; b) movement of people among municipalities of the same region, through private or public service transport, is prohibited unless health, work, study, or other urgent motives, or to access services, or carry out allowed activities that in the municipality or residence are not available; c) food service activities (including cafes, restaurants, pubs, ice cream and pastry shops) are suspended except for long term contract based canteen and catering services. Delivery services are allowed and takeaway until 10pm. Food retailers in highways, hospitals and airports are allowed.
Art. 3, same as Art. 2, allows the Minister of Health, on weekly basis, through ad hoc Orders to identify regions that due to the elevated transmission risks and rates need to be classified under “scenario 4” (Red Zones) as described under the document “Prevention and response to COVID-19: evolution of strategy and planning in the transition phase for the autumn-winter season” of 8 October 2020 (Annex 25). Art. 3, par. 4 establishes the further containment measures, limited to regions classified as “scenario 4" and these include: a) all movements are prohibited (either within the region or in/out of the region) except for work, health or other urgent reasons; for school attendance as allowed by the present decree; or to return to one's legal residence. Passing through red zones to reach one's legal residence is allowed. b) commercial activities are suspended, exception made for those selling food products and necessities specified in the attached Annex 1. Markets are also closed, except for stands exclusively selling food; c) foodservice activities (including cafes, restaurants, pubs, ice cream and pastry shops) are suspended. Delivery always continues to be allowed and takeaway until 10pm. Foodservice activities on highways, in hospitals, and in airports may continue.
Art. 4 continues granting operativity of production and commercial activities in respect of what established under shared protocol signed 24 April 2020.
Annex 9 contains guidelines for the reopening of commercial and production activities and recreational activities of the Conference of Regions and Autonomous Provinces of 8 October 2020; Annex 10 lists the criteria established by the Technical Committee to be followed in the preparation of work sector guidelines; Annex 11 lists measures for commercial activities; Annex 23 defines the small commercial businesses; Annex 25 contains the “Prevention and response to COVID-19: evolution of strategy and planning in the transition phase for the autumn-winter season” document signed 8 October 2020.
