Decree of the President of the Regional Council No. 28 implementing Regional Act No. 64 of 21 December 2001 making provision in matter of water discharges and laying down amendments to Regional Act No. 88 of 1 December 1998.

This Decree has been enacted in compliance with article 6 of Regional Act No. 64 of 2001, which provides for the adoption by the Regional Council of a Regulation intended to implement the same Act. The Decree is composed of five Chapters. Chapter I lays down general provisions. Article 3 of the present Decree regulates the monitoring on water discharges, giving particular regard to the special monitoring plan to be adopted by the Provinces, the Communes and the Optimal Territorial Areas (established under Regional Act No. 81 of 1995). Such monitoring plan shall give priority to controls on discharges as regards the impact they might have on the surrounding environment. Article 4 sets up a particular information system so as to ensure the proper exchange and availability of information in this field. Chapter II of the Decree is concerned with the issuance of new water discharge authorizations; Chapter III regulates the renewal of the authorization.
