Legislative Decree of 29 June 2010, n. 128 Amendments and additions to the Legislative Decree 3 April 2006, n. 152, containing norms in environmental matters, in accordance with article 12 of the Law No. 69 of 18 June 2009.

This Decree, taking into account the modifications made to the Environmental Code, here implements the amendments and additions related to the necessary principles and criteria as regards several environmental issues such as strategic environmental assessment procedures (including administrative action of State bodies and entities in charge of such affairs), specific environmental impact assessment and integrated environmental authorization provisions to be updated, and rules on the necessary protection of the air and reduction of emissions into the atmosphere (also part of the Legislative Decree no. 152/2006.
This Decree includes the updated sustainable development objectives of environmental protection related principles that are mandatory; also setting the substitutive powers of the Government, the power of the regions; further setting the discipline concerning the Integrated Environmental Authorization (AIA) in relation to the strategic environmental assessment (SEA) and evaluation of the environmental impact (EIA).
This Decree is in accordance with international obligations and redefines some issues in relation to the Economic and Social Council for environmental policies (CESPA).
