Legislative Decree No. 455 setting out the rules for the implementation of the Act amending the International Convention for the Protection of the New Varieties of Plant.

This Decree sets out the rules for the recognition and protection of new varieties of plants. In terms of Article 1 national norms on intellectual property will be applied to new varieties of plants. All rights, except the right of the creator are alienable and transmittable. The breeder is the person that has created or found and developed the variety. The variety is considered new when is clearly distinguishable by one or more important characteristics from any other variety whose existence is a matter of common knowledge at the time when protection is applied for. The breeder's right lasts twenty years running from the date of issuing. (31 Articles)
