Abstract
The Decree establishes the conditions to be satisfied in order to obtain the patent for a new plant variety for agricultural or industrial purposes. The intellectual property right includes the exclusive right to produce, place on the market and introduce in the territory the propagating material of the plant variety for which the patent has been issued. Specific rules are made with respect to the name to be given to the new variety by article 5. The Decree establishes the procedure to be followed (i.e. application, checks by the competent authorities and issuance of the patent). The Decree fixes at fifteen years the duration of the patent.
