Abstract
This Legislative Decree regulates the manufacturing, marketing and import of foodstuffs and food ingredients treated with ionizing radiation. Annex IV specifies the foods that may be treated with ionizing radiation (desiccated herbs, spices and condiments derived from vegetables). Said foodstuffs may be treated with ionizing radiation exclusively by using the resources laid down in Annex II, under the conditions established by Annex I and in the authorized installations defined by article 6, paragraph 1. Articles 6-8 make provision in matter of such authorizations. Article 12 concerns the registers to be kept by the holder of the installation in which ionizing radiation treatment is carried out. Foodstuffs treated with ionizing radiation may not be imported from third countries unless: a) they meet the requirements laid down by this Legislative Decree; b) they are accompanied by documents containing the information established by article 14, paragraph 1; c) they are treated in installations recognized by the European Community. The competent health authorities shall carry out official inspections as provided for by article 17. In case of detection of harmful effects on human health,the Ministry for Health shall undertake the suspension measures defined by article 16. Article 19 sets out the penalties to be applied in case of violation of this Legislative Decree.
