Presidential Decree implementing Presidential Decree of 12 April 1996-Environmental Impact Assessment-Directing and Coordinating Act-Supplement to Resolution No. 4 of 20 January 1999.

The present Decree consists of only one article which states the adoption of Resolution of the Regional Council No. 115 of 11 May 1999, which is hereby attached. The Resolution provides for the implementation of Presidential Decree of 12 April 1996 in matter of environmental impact assessment. The procedure referred to in article 10 of the above-mentioned Presidential Decree shall apply exclusively to the projects listed out in Annex B to the Presidential Decree itself. The following areas are considered to be areas of high environmental sensitiveness: protected nature areas; areas protected for hydrogeological purposes; nature parks and reserves; areas protected under the Regional Landscape Territorial Plan; areas at environmental risk. The assessment procedure is hereby fully regulated. The request shall be deposited with the Regional Territorial and Environmental Counsel. It shall be accompanied by a report on environmental effects and describing the project in question. If the Regional Counsel considers that the project should be subject to the EIA procedure, it shall apply the rules laid down in article 2 of the Resolution. Four Annexes are attached. Annexes A and B list out the types of projects hereby dealt with; Annex D contains the assessment elements to be taken into account.
