Abstract
This Act, consisting of 56 articles, concerns, in compliance with the regional statute, national and European law, the actions of the region, the metropolitan cities, the free municipal consortia and the municipalities in the government of the territory, and establishes the fundamental principles for the protection of the soil, in order to promote and protect the environment, the landscape and agricultural activity as well as to prevent further soil consumption. For the fulfilment of the territorial governance functions, the Act identifies the following objectives, in compliance with environmental sustainability: sustainable development of cities and regional territories improving the health and the quality of life; safety and reduction of territorial risks; reduce land consumption; sustainable urban regeneration interventions. The government of the territory is conducted on the basis of administrative principles and several plans: subsidiarity; sustainability; elimination of land consumption; public consultation and participation; simplification.
Concerning operative procedures, the Act provides for: territorial planning conference, including urban development in terms of environmental, social and economic sustainability; planning agreement, including integrated and coordinated action of local authorities, the Region and other public institutional subjects, joint partnership between public and private actors; territory monitoring and environmental assessment strategy, including planning of activities in environment, forestry, hydrogeological, parks and natural reserves; territorial and urban planning of cities and measures for creation of special protection areas for the conservation of wild birds, and for the protection of natural habitats, of flora and wildlife; measures on protected areas, protection of water, geological, hydrogeological, agricultural, forestry resources, reduction of noise, electromagnetic and atmospheric pollution, waste disposal; identification of strategic agricultural areas; definition of territorial threats connected to geological and seismic characteristics and flood risk management; protection and planning of the rural territory and protection of woods and forests, including afforestation, areas for biodiversity conservation; guidelines for urban and environmental quality standards.
