Abstract
This Regional Act implements Act No. 752 of 1985 in matter of gathering, cultivation and marketing of truffles. The Act consists of six Titles and one Annex. Title I lays down the general principles governing the truffle sector. The Emilia-Romagna Region aims at promoting and developing such sector and, at the same time, protecting the environment (art. 1). Title II regulates the administrative procedure intended for recognizing controlled and cultivated truffle areas, as per article 3 of Act No. 752 of 1985. Title III makes provision on gathering, which is subject to the issuance of an authorization by the competent entity (art. 8). Article 13 fixes the periods during which truffles may be gathered. Inspections shall be carried out by officers of the State Forestry Body (art. 16). Articles 17-19 lay down related penalties. Title IV regulates truffle collecting on public and protected areas. The Region encourages the creation of the Voluntary Consortia referred to in article 4 of Act No. 752 of 1985 as well as the establishment of local associations (art. 26). In accordance with article 30, an advisory commission shall be created under each competent entity. Such commissions shall formulate proposals and advices in matter of truffle gathering and related issues. An Annex, defining the environmental and installation conditions required for the cultivation of truffles, is attached.

This Regional Act repeals Regional Act No. 13 of 11 May 1981 as well paragraphs 4 and 5 of article 11 of Regional Act No. 2 of 24 January 1977.
