Abstract
This Regional Act, which consists of eleven Titles and three Annexes, lays down the legislative framework relative to the management and preservation of forest resources. The Act contains provisions that shall apply to woodlands and equivalent areas, as defined by article 4, as well as to trees and plant species pertaining to the regional forest heritage, as listed out in Annexes A1, A2 and A3. To attain the objectives fully defined in article 2, the Region shall rely on the cooperation and collaboration with local entities, environmental associations and other private entities. Article 5 regards the administrative functions and tasks which are assigned to the regional authority and local entities (Provinces, Communes and Mountain Communities).
As mentioned above, the Act is composed of eleven Titles. Title II regulates forest programming and planning. The major instrument is represented by the Regional Forestry Plan, the content of which is prescribed by article 7. With a view to ensuring the dissemination as well as access to relevant information, a regional information system is set up. Article 10 regards the drawing up of the forest inventory. Title III of the Act deals with the protection of forest landscape and ecosystems. Particular regard is given to the preservation of biodiversity and forest germplasm. Specific woodlands and forest areas shall be destined to this end. In these areas, certain activities, such as the gathering of plant species, is prohibited. In case the areas are owned by private individuals or legal persons, compensation shall be granted (art. 26). Articles 30 and 31 concern the protection of spontaneous flora and monumental trees respectively. Title IV deals with sustainable forest activities, giving particular regard to afforestation policies and wildlife species preservation. Title V is entirely devoted to the management of chestnut woods. Title VI is concerned with grazing in woodlands. Title VII makes provision in matter of production of propagating material. Title VIII is aimed at the prevention of the deterioration of forests, which includes fighting against forest fires and pests. Title IX describes public works to be undertaken in this field. Title X concerns the promotion of sylviculture. Article 84 lays down the penalties to be applied in case of infringement.
