Abstract
The Tuscany Region aims at protecting and preserving biodiversity, in implementation of Presidential Decree No. 357 of 8 September 1997 and in compliance with Directive 79/409/EEC. The Region takes into particular account biodiversity of: (a) wild animal species and non cultivated plant species; (b) habitats; (c) other natural elements falling within the regional territory. For this purpose, the regional authority: (a) recognizes the public relevance of natural and seminatural habitats; (b) guarantees their maintenance and preservation and, if necessary, their restoration; (c) contributes to the setting up of the European ecological net, to be known as Nature 2000 . To attain all these objectives, Annexes A and B define: (1) Sites of Regional Importance (Annex A); (2) protected animal species (Annex B) and animal species the capture of which is subject to restrictions (Annex B1); (3) protected plant species (Annex C) and plant species the gathering of which shall be subject to restrictions (Annex C1); (4) Sites of Regional Importance (Annex D) comprising sites of Community importance, Special Protection Zones (ZPS), Sites of National Interest (SNI) as well as Sites of Regional Interest (SRI). Article 3 specifies the functions which belong to the Provinces, such as the performance of biological studies . Part II of the Act lays down specific protection measures. In particular, article 5 prohibits certain activities that might interfere with the preservation of wildlife species (capture and hunting of protected animals, collection of nests and eggs, keeping and marketing of animals), without any prejudice to special authorizations that may be granted for scientific purposes. Article 6, on the other hand, shall apply to the protection of flora. Article 9 regards the recognition of flora and wildlife conservation centres. Further provisions refer to environmental impact assessment, surveillance and related penalties.
