Urgent provisions on agricultural enterprises' support implementing Art. No. 78 of the Decree-Law of 17 March 2020, No. 18, converted, with modifications, by the Law 24 April 2020, No. 27.

The Decree as prescribed by Art. No. 10-ter, paragraph 4-bis of the Decree-Law 27/2019, converted, with modifications, by law 44/2019 establishes that the recognised paying agencies, under the support schemes of Common Agricultural Policy (EU Regulation No. 1307/2013), can start pay advance grant funding to farmers. The market interest rate applied to fund anticipation is defined on the basis of the reference rates established pursuant to Communication from the European Commission 2008/C 14/02 (Official Journal of the European Union, no. C14 of January 19, 2008) The anticipation granted does not involve elements of state aid.
The interest payable on the advance is offset to farmers through a direct grant which constitutes State aid notified pursuant to Art. No. 107, paragraph 3, letter b) of the Treaty on the Functioning of the European Union, on the basis of section 3.1 of the communication from the European Commission Temporary framework for "Supporting state aid measures of the economy in the current emergency of COVID-19".
