Abstract
DL 18/2020 (Cura Italia) is a "maxi" piece of legislation that makes available further additional funding to support the public health system (Title I - Artt 1-18) and work (Title II) and specific financial support measures for public and private sector.
The DL 18/2020 lays down several financial mechanisms to support the agricultural and fishing sector; it poses extra strenght to the cassa integrazione in deroga instrument and extends it to all agricultural and fishing workers and seasonal workers without continuity of employment and provides extra funds to the fondo di integrazione salariale (Artt. 19-22).
Art. 30 outlines the conditions for requesting an Agricultural workers' allowance due to COVID-19 (Fixed-term agricultural workers, not pensioners, who in 2019 have carried out at least 50 actual days of agricultural works activities, are granted an allowance for the month of March equal to 600 euros).
Art. 32 postpones the deadline for submitting agricultural unemployment applications to 2020.
Art. 72 reinforces the Fund for the integrated promotion.
Art. 78 establishes a EUR 100 million fund for agricultural, fishery and aquaculture enterprises to ensure total coverage of interest expense on bank loans for working capital and for debt restructuring, to cover costs incurred for interest accrued in the last two years on mortgages contracted by same companies, as well as for the temporary arrest of the activity of fishing. PAC contributions are incremented to a 70% (from 50% in DL 27/2019); additional EUR 50 million are given to the Indigent fund (under A. 58 DL 83/2012) to ensure the distribution of food resources (in addition to the 6 million already destined in the past few days for the purchase of raw milk, in agreement with the Food Waste Table).
Beyond these specific agriculture related financial mechanisms the food supply chain benefits of many more instruments set by the DL 18/220 to support workers and business in general; e.g. Art. 49 simplifies the procedures to access to the Fondo di Garanzia for Small-Medium businesses including those one working in the agricultural and fishery sector; and several facilitation are made for mortgages and loans (e.g. Art. 112, Art. 112, Art. 56, among others).
The Law of conversion (Law 27/2020) outlines the modifications to the Decree-Law 18/2020 in Annex 1 and repeals the Decrees-Law 9/2020, 11/2020, 14/2020. The Law also, in consideration of the state of emergency, extends by three months the terms for the adoption of legislative decrees expiring between 10 February 2020 and 31 August 2020, which have not expired yet on the date of entry in force of this law. Furthermore, the legislative decrees that has already expired on the date of entry into force of this law, may be adopted within three months from the date of entry into force of the this law, in compliance with the guiding principles and criteria and procedures provided by the respective delegation laws.
