Abstract
These Regulations make several amendments in the Fishing Industry (Spiny Lobster) Regulations of 2009. In addition to the authorized storage facilities designated by the Minister of Agriculture and Fisheries, these Regulations lay down rules for the storage facilities which are approved by the Minister of Agriculture and Fisheries for the storage of spiny lobster during a closed season. Regulation 4 of the Principal Regulations is amended relating to the declaration to sell, export or process spiny lobster during closed season of whom has possession of any spiny lobster that was lawfully fished before the date of commencement of the closed season. Regulation 4A is added to the Principal Regulations relating to the application procedures for storage during closed season of spiny lobster that was lawfully fished before the date of commencement of the closed season, and to sell, export or process spiny lobster after the end of that closed season. The storage of spiny lobster for the duration of the closed season may be authorized by the Minister of Agriculture and Fisheries. Regulation 5 of the Principal Regulations is amended by expanding the powers of the Fishery Inspector to enter and inspect premises, authorized storage facilities and approved storage facilities. Regulation 7 of the Principal Regulations is amended by adding Regulation 7A relating to the duties and obligations of the approved storage facility, Regulation 7B relating to the duties and obligations of the approved storage facility after revocation, Regulation 7C relating to the prohibition for access to or handling any spiny lobster stored in an approved storage during a closed season, and Regulation 7D relating to the date for an application made under Regulation 4A.
