Abstract
This Act, consisting of 19 articles, divided into five Parts, provides for protecting geographical indications and preventing their misleading use. The Act defines: geographical indication, as an indication which identifies a good as originating in the territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin; good as any natural or agricultural product or my product of industry or handicraft. The Act concerns: application to the court to prevent unfair competition, misuse of geographical indications, and misuse of the origin of wine and spirits; protection of homonymous geographical indications; geographical indications excluded from protection; offences; registration of geographical indications and application for registration; right to use geographical indications; Ministerial power to issue Regulations; special provisions related to trademarks; trademarks conflicting with geographical indications concerning wine and spirits.
