Abstract
This Act: provides a framework for the effective functioning of the International Treaty on Plant Genetic Resources for Agriculture in Jamaica; enhances the conservation and sustainable use of plant genetic resources; facilitates access to, and use of, plant genetic resources; and promotes the equitable sharing of benefits arising out of the their use. The Act establishes a Management Authority. The Authority shall, among other things, advise the Minister on policies and legal measures for the furtherance of objectives stated in this Act and ensure the integration of activities under the Treaty into the Government's relevant agricultural and rural development policies and programme.
The Act furthermore: specifies the entities that may obtain access to any listed plant genetic resource for the purpose of research, breeding or training for food and agriculture, in accordance with the terms and conditions of a standard material transfer agreement, between that entity and the owner of the plant genetic resource; prescribes the form of a standard material transfer agreement; establishes the Plant Resources Fund; requires the Management Authority to establish and maintain, in such form as may be prescribed, a register of plant genetic resources; and provides with respect to certain powers of the Minister. The First Schedule sets out the composition and procedure of the Management Authority, the Second Schedule sets out a Standard Material Transfer Agreement, and the Third Schedule a specifies a list of crops specified in Annex 1 of the Treaty.
