Abstract
This Law consisting of 36 articles aims to divide powers and competences between the Ministry of Energy and Mineral Resources and the Energy and Minerals Regulatory Commission (EMRC) regarding the production, circulation and management of petroleum products in Jordan. The Ministry handles the following powers and mandates (i) prepare and develop the strategy and policy of the sector and submit them to the Council of Ministers for approval; (ii) care for the Kingdom’s interests in the sector at regional and international level; (iii) encourage investment and competition in the sector; (iv) adopt the necessary measures to maintain a strategic reserve of crude oil and petroleum products, including the method of managing this reserve and how to finance it, and identify the procedures related to the implementation of the contingency plan to supply petroleum products; (v) contribute to building an integrated information system; (vi) develop draft laws related to the Sector. EMRC handles the following powers and mandates (i) grant permits or licenses; (ii) control the permit holder and the licensee to ensure their compliance with the provisions of this Law; (iii) participate in developing standard specifications or technical rules of plant, facilities, and materials related to the work of the Sector; (iv) take part in setting the necessary requirements for meeting the environmental conditions to be satisfied by the plants and facilities.In particular, the Council of Commissioners handles the following powers and mandates (i) issue licenses and permits in connection with the import, sale, export, transport, storage, and refining of crude oil, petroleum products, biofuel, or coal; (ii) set principles and criteria related to the sector; (iii) set proper performance rules, safety, security, and sustainability criteria.
The Law establishes that (i) no action in the sector can be taken without permission from the competent Authority; (ii) the rules for submitting applications; (iii) validity of permits; (iv) duties and responsibilities of the permit holder or the licensee; (v) reasons for cancellation of permits; (vi) prices of petroleum products, commissions, and tariff of the licensee shall be determined by the Ministry; (vii) EMRC, in cooperation with the participants in the supply chain, shall provide an contingency plan to supply Petroleum Products to the Ministry.
