Abstract
This Act aims to secure agricultural water by taking necessary measures for the proper management and conservation of agricultural reservoirs, and to protect the lives of the people from floods and other disasters caused by the collapse of agricultural reservoirs, so as to protect property and thereby contribute to the sustainable development of agriculture and the conservation of national land. The Act consists of 6 Chapters: General Provisions; Management of Agricultural Reservoirs; Designation of Specific Agricultural Reservoirs, etc.; Management of Specified Agricultural Reservoirs by Arbitration; Miscellaneous Rules; Penalties.
Owners (including managers) of agricultural reservoirs shall strive to properly manage the agricultural reservoirs so that the functions of the agricultural reservoirsare fully demonstrated(Art.5). A person who intends to excavate land, fill or cut land, plant bamboo and trees, or perform any other act specified by Cabinet Order that may affect the conservation of the specified agricultural pond with respect to the specified agricultural reservoirs, permission must be obtained in advance from the prefectural governor (Art.8).
