Abstract
This Act provides for the establishment of the Coffee Board of Kenya, a Standing Joint Committee, an Advisory Panel and a Coffee Licensing Advisory Committee and provides for public control of the processing and marketing of coffee in Kenya and the international trade in Kenyan coffee. The Act consists of 38 sections divided into 7 Parts.
The Coffee Board of Kenya shall consist of Government officers, experts and representatives of plantation and the cooperative societies and smallholders who are producers of coffee. The Board shall be responsible for the promotion of the coffee industry including the marketing and processing of coffee, the licensing and control of producers and processors of coffee, and research connected with the industry. The Board shall be a body corporate. The Coffee Licensing Advisory Committee shall advise the Board upon the issue of licences under this Act, i.e. various trader’s licences, a broker licence, a warehouse licence or a miller’s licence. No person shall buy, sell, export, mill, warehouse or otherwise deal in or transact any business in coffee unless he or she is the holder of a licence issued by the Board. The Act also provides for licences for the planting of coffee and a licence to operate a pulping station. Coffee millers shall be registered under this Act. The Act places restrictions on export and sale of coffee by planters. In principle, planters shall sell their produce to the Board and no person other than the Board shall purchase coffee from any coffee planter.
