Abstract
This Act grants powers to the Minister and certain local authorities to issue rules relative to crop or agricultural produce declared by the Minister to come under the operation of this Act.
The Minister may, by Order, apply the whole or any part of this Act to the whole or part or parts of Kenya. "Agricultural produce" means any article produced or derived from farming operations and includes meat and all other products derived from livestock and "crop" includes all trees grown for timber, fuel or food production, or any other purpose. The Minister may for the purpose of promoting quality in agriculture, regulate various matters including: improvement of crops and methods of agricultural produce in general; the varieties that may be planted, including trees; control of diseases and pests; grading of agricultural produce; the inspection of any crop or agricultural produce; and the licensing and control of trading in or production of any agricultural produce or crop. Rules providing for a system of licensing may empower the licensing authority to attach conditions to a licence or to refuse to grant or renew a licence on any ground which appears to the licensing authority to be reasonable and in the interests of the production, improvement, marketing or processing of the agricultural produce or crop concerned. Subject to the approval of the Minister for the time being responsible for animal husbandry, a municipal council, an urban council and an area council may each make By-laws, applicable to its area, relative to specified matters of animal husbandry. The Act declares contravention of the provisions of any Rule or By-law made under this Act to be an offence.
