Abstract
These Regulations concern the prevention of pollution that can affect the coast, in particular oil pollution. They implement provisions of the International Convention for the Prevention of Pollution from ships 1973 (MARPOL) as amended.
No ship shall be allowed or discharge any hazardous substance (not defined), chemical, oil or oily mixture into the territorial waters or any other part of the environment contrary to the provisions of these Regulations. Oil and other prescribed waste substances shall be off-loaded at the certified Port Waste Facility at Mombasa port. Regulation 4 defines the application sphere of the Regulations. Every ship shall be required to carry an Oil Record Book and all ships shall be required to obtain a Certified Port Waste Reception Facility in accordance with MARPOL. No ship shall be allowed to leave a Kenyan port without producing a valid discharge certificate. Inspection shall be carried out by officers appointed or authorized by the Director-General of National Environment Management Authority. (9 regulations completed by 1 Schedule)
