Abstract
These Regulations, made under provisions of section 208(2)(o) of the Fisheries Management and Development Act, 2016, apply to any person, vessel or other craft undertaking any fishing or a fishing related activity in Kenya inland fishery waters. The Regulations concern the following topics: anadromous and catadromous fish; artisanal fisher; fishing trip; inland fishery waters; ornamental fisher; potamodromous fish; protected area; artisanal inland fishing vessel registration certificate. The Regulations aim at: promoting the realisation of economic benefits from Kenya inland fishery resources; providing for fees and other charges for promoting development of artisanal fishers; ensuring management and conservation of inland fishery resources; strengthening monitoring, control and surveillance within Kenya inland fishery waters.
Matters covered by these Regulations include: procedure for registration of artisanal and semi-industrial inland fishing vessel certificate; artisanal inland fisher’s licence; compliance with standards for seaworthiness and safety of life at sea; issuance of licences for trading in fish and fish products; freshwater ornamental fishing licence; conservation and management measures; landing of fish; minimum and maximum landing size of fish; prohibition on the introduction on new fish species into an inland water body; protection of fish in breeding areas; permitted and prohibited fishing methods; respect of local communities traditional access to fishing grounds.
