Abstract
These Regulations, made under provisions of section 208 of the Fisheries Management and Development Act, establish: modalities for accessing Kenya marine fishery resources; terms and conditions for harvesting marine fishery resources; economic benefits from marine fishery resources sustainable use; the promotion of food and nutrition security; levies for promoting the development of artisanal fishers; management and conservation of marine fishery resources; monitoring, control and surveillance mechanisms to eradicate illegal, unreported and unregulated fishing within Kenya marine fishery waters. The Regulations apply to persons, vessels or other crafts undertaking any marine fishing falling in the Kenya marine fishery waters, including internal waters, the territorial sea and the exclusive economic zone. The Regulations cover the following matters: procedures for registration and licensing of fishers and fishing crew; requirements for subsistence, artisanal and ornamental fishing; qualifications for foreign industrial fishers; landing requirements and application for transhipment; specific authorisation to fish in the high seas; notification to enter or exit Kenya marine fishery waters; registration and licensing of fishing vessels; fees and bycatch levies; restrictions on the prawn trawl and ring net fishing.
