Abstract
These Regulations, made under provisions of sections 12(3), 153(3) and 223(2),(c),(d),(g),(j),(k) and (l) of the Mining Act, 2016, concern all mineral rights, and cover the following relevant topics: artisanal mining area; artisanal mining committee; cadastre, as an online repository and information management tool established for the purposes of regulating the issuance of licences and permits of mineral rights and dealings in minerals; cadastral map; cadastral register; dealer's rights; exploration; feasibility study; invasive activities; mine development; mining permit programme; programme for prospecting operation. Matters covered by these Regulations include: public access to the online mining cadastre; content of the register; application for licences and permits; environmental standards to comply with and requirements in support of an application; discovery of new minerals; meetings of the Mineral Rights Board; general provisions on mineral rights, including: demarcation of mining right area; consent from land owner to conduct mineral or mining operations; boundary disputes; transfer and mortgage of mineral rights; land compensation guarantee bond; suspension and revocation of mining rights; licence for large scale mining operations; mining licence; permit for small scale mining operations; artisanal mining permit.
