Abstract
These Regulations implement provisions of the Water Act, no. 43 of 2016 concerning water harvesting systems and storage and waterworks and shall apply to the policies, plans, programmes and activities of the national government, county governments and their entities and public and private waterworks for water harvesting and storage, reservoirs for impounding surface run-off and to the stream flows to synchronize them with water demand patterns and structures for flood control and management.
Matters covered by these Regulations include: classification of storage dams and other waterworks; requirements and development for construction of waterworks, on the basis of the right to store water; release and use of water from storage dams and other waterworks; maintenance and management of waterworks, including inspection and reports; strategic water emergency intervention and data monitoring to be conducted by the Water Storage Authority, in order to prevent and manage floods and other impacts on climate change; the water harvesting policy and strategy to be implemented by the Cabinet Secretary; licensing of qualified professionals and contractors in respect to waterworks; offences.
