Abstract
This Law primarily addresses the legal and policy framework for citizens' health protection, emphasizing the comprehensive, integrated health system encompassing public and private sectors. Its objectives include safeguarding citizens' rights to health, establishing public authority powers, regulating health organizations regardless of ownership, and defining rights and obligations of individuals and groups in health matters. The legislation is grounded in constitutional principles, international law, and treaties, aiming to uphold non-discrimination, accessibility, and social protection in health services. Key measures include the development of a unified health system, the implementation of public health policies, and the regulation of health care provision through standards, accreditation, licensing, and quality management. The Law details the organization of health services, including primary, specialized, palliative, and emergency care, as well as specific provisions for vulnerable groups such as pregnant women, children, persons with disabilities, and those with infectious or non-communicable diseases. It establishes the State Guarantees Program to ensure free or favorable health services, and mandates the development of clinical protocols, digital health activities, and biomedical research, with clear responsibilities assigned to public health authorities. Implementation mechanisms involve institutional responsibilities such as the Public Health Authority's role in policy execution, monitoring, and oversight, with timelines for aligning regulations and standards. The Law specifies procedures for licensing, accreditation, medical examinations, and stakeholder involvement, including public and non-governmental organizations. Enforcement is supported by provisions for liability, penalties, and international cooperation.
