Abstract
This Law provides for the management, harvesting, use, development and conservation of the forests (natural or planted) in the Kingdom of Cambodia. The text of the Law consists of 109 articles divided into 18 Chapters: General Provisions (I); Forestry administration (II); Sustainable forest management (III); Permanent forest estate (IV); Forest concession management (V); Management of production forest not under concession and protection forest (VI); Permits and authorizations (VII); Prohibition on harvesting forest products and by-products and protection forests (VIII); Customary user rights, management of community forest and private forest (IX); Wildlife conservation (X); Royalties and premiums on forest products and by-products (XI); Reforestation and national forest development fund (XII); Measures governing forestry activities (XIII); Resolving procedures for forestry offences (XIV); Forestry offences and legal penalties (XV); Enforcement of court verdict (XVI); Transitional provisions (XVII); Final provisions (XVIII).
Chapter II specifies duties of the forestry administration in relation with forest management and forest resources. Chapter IV defines permanent forests and private forests. The Royal Government of the Kingdom of Cambodia may grant and area of production forest not being used to a forest concession through public bidding as described in Chapter V. Individuals or legal entities do not have the right to clear forestlands, harvest forest products or by-products, occupy land, etc, within permanent forest reserves as defined in Chapter VIII except for local communities living there. They will be ensured their traditional user rights listed in Chapter IX without the need of permits. Chapter X defines wildlife specimens and all prohibited activities related to them. All wildlife species are state property under the management jurisdiction of the forestry administration. The Cambodia Government encourages tree planting and reforestation and all people are obliged to participate in this matter as described in Chapter XII.
