Abstract
This Act establishes a framework for the systematic preservation, management, and sustainable use of natural heritage that holds historic, scenic, or academic value.
The term natural heritage encompasses various elements, including animals, plants, geological formations, natural landscapes, and historic cultural landscapes, all of which are recognized for their significant value. Specific definitions are provided, such as protection zone, which refers to areas designated to protect natural monuments, and traditional landscaping, which involves creating spaces using traditional methods that reflect cultural heritage. The Administrator of the Cultural Heritage Administration shall formulate a plan for protecting natural heritage, which covers: 1.Basic directions and objectives for the preservation, management, and utilization of natural heritage; 2. Analysis and evaluation of the previous protection plan; 3. A research and survey plan for natural heritage by type; 4. Major tasks to be promoted for the preservation and management of natural heritageby type; 5. fund raising; etc.(art.6). The State or a local government may establish an management agreement with the owners, etc. of natural monuments, etc. (including protective facilities, protection zones, and historic and cultural environment preservation areas) for their preservation, management, and utilization (art.44). A person who intends to conduct any of the acts as listed in Article 17 in connection with naturalmonuments or scenic spots shall obtain permission from the Administrator of the Cultural Heritage Administration. The Cultural Heritage Administration may provide subsidies for these agreements, but non-compliance can lead to termination of the agreement. The Administrator of the Cultural Heritage Administration shall manage animals that are natural monuments, to prevent them from contracting a disease or from transmitting and spreading diseases (art.31).
The Act further makes provisions, for: designation of natural heritage, designation of management organization, management of animals that are natural monuments, reporting, compensation for losses, offences and penalties, etc.
