Abstract
This Enforcement Decree of the Act on the Exercise of Sovereign Rights on Foreigners’ Fishing within the Exclusive Economic Zone implements the corresponding Act and establishes detailed rules governing foreign fishing activities within the Republic of Korea’s Exclusive Economic Zone (EEZ). It provides for exercising sovereign rights over marine living resources and regulating foreign access to Korean fishery zones.
The Decree prescribes licensing and permit requirements for foreign fishing activities, including vessel size, fishery type, accompanying vessels, and target species. It designats specifically prohibited zones and regulates access fees, exemptions, enforcement measures, revocation of permits, seizure and detention procedures for violating vessels, bail arrangements, and the roles of fisheries authorities, judicial police officials, prosecutors, and foreign flag States in ensuring compliance.
