Abstract
The purpose of this Act is to contribute to the continuous development of fisheries and to the income growth of fisher by establishing plans for the management of fishery resources and efficiently managing fishery resources through the prescription of matters necessary for the protection, recovery, formation of fishery resources.
The Act provides for the establishment and implementation of fishery resources management plans in order to comprehensively and systematically manage fishery resources. In order to comprehensively and systematically manage fishery resources, the Minister of Oceans and Fisheries shall create a master plan for the management of fishery resources. The Minister of Oceans and Fisheries or Mayors/Do Governors shall formulate a fishery resources management implementation plan.
The Minister of Oceans and Fisheries, in order to protect fishery resources, may: determine a period, zone, depth of water, etc. for which the capture and gathering of fishery resources are prohibited; determine fishing prohibited zones; prohibit the sale, possession, distribution, etc. of illegal catches; establish periods of suspension of fishing; restrict the number of fishing vessels in operation; restrict the tonnage of fishing vessels; prohibit the use of certain fishing gear; prohibit the use of explosives, poisons or electricity for fishing; etc.
The Act establishes and allocates total catch quotas for each fish species and sea area for the recovery and conservation of fishery resources.
The Act further provides for: the designation and management of protected waters for the spawning of fishery resources, development of aquatic seedlings or growth of fingerlings; designation and management of waters for fishery resources management where sedentary fishery resources have developed; restrictions on acts in protected zones; establishment and operation of a Central Fishery Resources Management Committee; penalties; etc.
