Abstract
The purpose of this Act is to preserve the environment and to relieve any damage to the health and property of citizens by providing procedures of conciliation, mediation, and arbitration in order to settle any environmental dispute rapidly and efficiently. The Act consists of 6 Chapters divided into 66 articles: General provisions (I); Environmental dispute adjustment committee (II); Dispute adjustment (III); Adjustment of disputes involving numerous persons (IV); Supplementary provisions (V); Penal provisions (VI).
Central and local environmental dispute adjustment committees shall be established and shall control affairs described in article 5. A person who desires to request for adjustment shall submit the written application for conciliation, mediation, or arbitration to the committee of jurisdiction. A conciliation committee shall be nominated. In case where great environmental damage takes place and the damage is left untouched, and it is expected to have a serious impact on society, and if the dispute is left unsettled, the central adjustment committee may begin ex officio the mediation procedure. When it is deemed necessary to arbitrate a dispute, an arbitration committee may perform any of the acts listed in article 38.
