Abstract
This Act aims to properly manage mining damage in order to protect the natural environment.
The Act provides for the preparation and implementation by the Minister of Knowledge Economy of mining damage prevention master plans and of mining damage prevention action plans.
The Act sets out activities necessary to prevent mining damage occurring in active mines, inactive mines and abandoned mines. These include: restoration of deteriorated areas; removal and disposal of facilities, materials, etc. unused in abandoned mines; installation, operation and management of mining damage prevention facilities; and investigations of soil.
The Act further provides for: requirements and procedures for registering as specialized mining damage prevention business operators; obligation to report to the Minister of Knowledge Economy the results of the mining damage prevention; expropriation, use, etc. of land for the installation, management and maintenance of mining damage prevention facilities; creation of the Mining Damage Prevention Funds; inspection, maintenance and management of mining damage prevention facilities; establishment of the Mine Reclamation Corporation to conduct mining damage prevention businesses; penalties; etc.
