Abstract
This Decree consisting of 28 articles aims at protecting biodiversity in compliance with the Law No.42 of 2014, with particular regard to fishing and hunting (art.100) and Cites Agreement implementation (art.101). The two main Authorities responsible for the issue are the Environment Public Authority and Public Authority for Agriculture Affairs and Fish Resources. The latter deals with (i) issuing fishing permits; (ii) fishing fees; (iii) permitted methods and equipment; (iv) GPS use; (v) seasons and places for fishing; (vi) exemptions for scientific reasons. Article 5 of the Regulation lists places and cases where fishing is prohibited, with the exemptions. Regarding hunt, the Decree regulates, inter alia, (i) types of weapons allowed; (ii) methods; (iii) prohibited species; (iv) issuance of permits; (v) seasons and timing.
As for the CITES implementation, responsible body is the EPA. It (i) develops legislation on the international trade of endangered species; (ii) prepares reports; (iii) sets up rules and measures for the Agreement implementation. While the Public Authority for Agriculture Affairs and Fish Resources (i) issues permits and Cites certification; (ii) establishes agricultural quarantine centers; (iii) prepares health certificates for imported/exported species. The two Authorities work in coordination with a Scientific authority.
Article 103 of the Law No.42 deals with Natural Reserves and the Decree regulates (i) fishing in the nearness; (ii) construction projects; (iii) entry rules; (iv) reserves management. Article 107 of the Law deals with grazing. The Decree establishes that responsible body is Public Authority for Agriculture Affairs and Fish Resources. Kuwait Bay, provided for in art.108 of the Law, is environmental protected due to its particular environment. For this reason, sewerage, fishing, building, aquaculture are regulated in the Decree.
