Abstract
This Law consisting of 37 articles aims at safeguarding consumer rights and creating an instrument of control to ensure such rights are properly defended. The Law establishes a national Committee for consumer protection composed of representatives of governmental entities and be chaired by the Minister of Commerce and Industry. Its main tasks are as follows (i) creation of a general policy for consumer protection; (ii) development of plans and programs for the protection, promotion and development of consumer rights; (iii) investigation of complaints received from consumers or consumer protection societies; (iv) reporting of violations to the concerned authorities; (v) verification that goods and services meeting with specifications and quality standards; and (vi) cooperation with consumer protection bodies regionally and internationally. To implement the Consumer Protection Law, art.7 provides for granting certain Committee members the authority - including the right to access, obtain and examine documents and records from any government or non-government authority - to take action against its violators.
Articles 9 - 11 deal with the Rights of Consumers. Art.9 lists these rights as follows (i) right to safety; (ii) right to quality; (iii) right to be informed; and (iv) right to redress. Art. 10 allows the consumer to replace or return a defected product within 14 days of purchase and further states that vendors and suppliers are jointly liable in such respect. And art.11 states that every clause in a contract or document related to contracting with a consumer shall be invalid if it exempts the merchant or service provider of any of his obligations under the Consumer Protection Law.
As for the advertising, the Law establishes that certain details of a product must be included in Arabic, in a clear and legible manner, in accordance with the standard specifications approved in Kuwait, particularly the product date, the expiration date, the ingredients, any inherent hazards, and the precautions to take in using the products and to avoid any risks.
The Law deals also with (i) product display; (ii) replacing of a defective product; (iii) issuance of invoices, written in Arabic confirming the product, the date of sale and purchase, the price, the quantity, type etc.; (iv) prohibition of the sale or rent of hazardous materials or products to anyone under the age of 18; (v) compensation for damages incurred by a consumer due to a defective good or service; and (vi) penalties.
