Ministerial Decree No.190 of 2008 on the Regulation of Hygiene and Transport of Waste.

This Decree consisting of 28 articles aims at regulating the disposal of wastes resulting from residential and urban communities and related social, economic and development activities. These wastes are classified according to their quality and source of production as (i) municipal waste, such as residential, commercial and office waste as well as animal, agricultural and those resulting from slaughterhouses and some types of industrial waste (non-hazardous) and scraps of household appliances, cars and others; and (ii) structural waste and construction debris resulting from the demolition of buildings and those left behind by the construction of new buildings and the restoration and maintenance of existing buildings.
The Regulation establishes (i) waste removal sites to be close to the place where the waste is generated); and (ii) treatment sites, designated by the Municipality and where the waste is treated by recycling, burning, filling it or by any other means approved by the concerned authorities.
To transfer the waste from the source of its production or its presence to the place of treatment the Municipality designates a qualified company or an organization. The Decree also establishes that (i) it is prohibited to transport sanitary sewage and absorption pools in non-licensed vehicles; (ii) the drivers of these vehicles shall take the necessary precautions to prevent water leakage while transporting; (iii) it is admitted to transfer the waste, whatever its source, only by the companies and institutions licensed for this purpose, accompanied by a valid certificate from the Municipality; (iv) the licensed waste carrier must comply with the installation of the GPS tracking system (black box) to follow the movement of vehicles to the waste disposal site; (v) the waste transfer statement must be visible on the transfer vehicle and include the following information: waste description, waste source, the receipt of the waste carrier, and the processing facility and record of receipt and treatment of waste.
