Abstract
This Decree on Import and Export of Goods (Government No. 114/GoL) sets out principles, rules and measures governing the import, export, temporary import, temporary export and transhipment of goods into and out of the Lao PDR. Its objective is to facilitate, promote and administer foreign trade to support socio-economic development and improve people’s standard of living.
The Decree emphasizes trade facilitation, non-discrimination, transparency and compliance with relevant laws and treaties. The Decree identifies core administrative measures: prohibition of import/export; licensing requirements; sanitary and phytosanitary (SPS) and technical regulation (TBT) requirements; and trade remedy measures (anti-dumping, countervailing and safeguard) consistent with applicable treaties. It mandates that the Ministry of Industry and Commerce coordinate with line ministries to prepare lists of prohibited imports/exports, goods subject to licensing, goods subject to SPS/TBT control, and the competent administration authorities. Licensing and certification procedures are to be issued in separate regulations. The Decree assigns rights and duties to importers, exporters and Import and Export Administration Authorities, including license issuance, monitoring, dispute petitions and collection of related fees.
