Abstract
This Act, consisting of 466 articles and divided into nine Parts, provides for defining a framework for the consolidation and the reform of the legislation applicable to labour and industrial relations in Saint Lucia, in compliance with existing local standards and international labour Law standards, and applies to all employees including domestic workers, homeworkers and people employed at all workplaces. The Act defines the following relevant terms: biological agent; authorised officer; chemical; collective agreement; contract of employment; critical substance, as a chemical agent, physical agent or biological agent, or combination thereof prescribed as a critical substance to which the exposure of an employee is prohibited, regulated, restricted, limited or controlled; employee; employer; existing industrial establishment; hazardous biological agent; hazardous chemical; hazardous physical agent; hazardous substances; major hazard installation; exploration of mineral resource; extraction of mineral resources; occupational disease; physical agent, as electromagnetic radiation, ionising radiation, noise, vibration, heat, cold, humidity and pressure; trade union; wages; work permit; young person; child.
Part II of the Act focuses on: fundamental principles of employment, and concerns: prohibition against forced labour, and against discrimination; protection of freedom of association. Part III focuses on: contracts of employment; fines for false particulars and contraventions; hours of work; prohibition of work on public holidays; payment of wages; fixing of minimum wage; sick leave and benefits; vacation leave; public contracts; employment of children and young persons, prohibitions and exemptions, register of children and young persons; medical certificate of fitness; regulations for the employment of young persons; penalties for child and young person labour; termination of employment. Part IV concerns occupational safety and health measures, and includes: registration and requirements of industrial establishments; specific provisions for the health of a young person; inspection of workplaces; prohibition of children in the industrial establishments; adequate supply of wholesome potable water; maintenance of lunchrooms in the industrial establishments, with adequate lighting, ventilation and drinking water; disposal of industrial waste; measures to prevent hearing impairment caused by noise in the establishments; safety measures in case of fire; prohibition of certain chemicals, physical agent or biological agent, and appeals against prohibition orders; measures to protect workers from biological agents' effects; inventory of chemicals and biological agents; labelling of chemicals; information from manufacturers of hazardous substances.
Further matters covered by this Act concern: notification of accidents and occupational diseases; duties and responsibilities of employees, employers and other persons; equality of opportunity and treatment in employment; definition of prohibited grounds of discrimination; maternity benefits and protection; overseas employment and related work permits; settlement of disputes in the essential services; trade disputes; disputes resolution and powers of Labour Department; establishment of Labour Tribunal and description of its procedure; general offences against administration; penalties.
