Abstract
This Law establishes the legal basis for noise prevention, the rights of the noise management entities, the duties of the noise control and monitoring (assessment) procedures. The purpose of this Law shall be to regulate the management of noise-affected activities to prevent hearing loss or deterioration, protect human life and health and the environment from the negative effects of noise pollution. It shall not be applicable to noise caused by and against the person himself, noise in the workplaces and vehicles, as well as noise from military operations in military areas. Acoustic planning is the planning of controlled noise management (planning of land use, designing of transport systems, planning of transport, anticipation of noise abatement methods by various means and limiting noise in its sources). Daily noise indicator is the indicator of noise caused during the day (from 6:00 to 18:00), i.e. the average long-term A-weighted sound level set for the one-year day period. Noise prevention shall be intended implementation of measures to reduce the diversity and/or number of sources of noise preventing the exceeding of noise limits and/or noise emission sources, sound pressure, power, strength, energy levels. Basic principles of noise management: (a) "noise immunity" means no person shall be exposed to noise levels which endanger his life and health; (b) ensuring the quality of human life; (c) informing the public; (d) promotion of activities aimed at making the noise the problem universally understood; (e) state support for noise management. Basic noise management measures: (a) traffic flow planning; (b) spatial planning, project expertise and maintenance of structures; (c) land-use planning; (d) technical measures in noise sources (selection of lower noise sources, reduction of noise in the source, noise reduction in the field of impact); (e) reduction of sound transmission; (f) regulation of economic activity conditions and noise calibration; (g) noise control; (h) assessment of the impact of the proposed economic activity on public health and the environment, public health safety assessment, assessment of the impact of noise on public health; (i) conformity assessment of products; and (j) strategic noise mapping and noise level detection zones. This Law consists of IX Sections. Section I lays down general provisions. Section II regards noise management. Section III deals with noise indicators and evaluation methodology applicable thereto. Section IV establishes strategic noise mapping and preventive planning. Section V regards noise control. Section VI regards access to noise-related information. Section VII regards noise regulation. Section VIII defines personal rights and obligations. Section IX lays down final provisions.
