Abstract
This Law establishes the basic requirements for packaging, the general requirements for the accounting, marking, collection and use of packaging and packaging waste produced in the Republic of Lithuania and imported into the Republic of Lithuania, in order to avoid the negative impact of packaging and packaging waste on the environment and human health, as well as on manufacturers, importers, the rights and obligations of sellers, consumers, waste handlers when handling packaging and packaging waste. This law applies to all packaging users and economic operators. Operators of economic activities shall be intended the following categories: (a) suppliers of packaging materials, manufacturers of packaging, manufacturers of packaged products, importers, sellers, distributors, packaging waste handlers, other organizations provided for in other organizations provided for in this and other laws; and (b) supply of packaging to the domestic market of the Republic of Lithuania and handling of packaging waste coordinating institutions authorized by the Government. It classifies the types of plastic packaging. The packaging must be manufactured in such a way that the largest possible part of the mass of the packaging can be processed into products that meet the standards applicable to those products in the European Union and/or the Republic of Lithuania. The recyclable part of the packaging mass depends on the properties of the packaging materials. This Law shall lay down the general requirements for record keeping, marking, collection and use of packaging made in the Republic of Lithuania and imported into the Republic of Lithuania and of packaging waste, with a view to preventing a negative impact of packaging and packaging waste on the environment and human health; it shall also establish the rights and duties of manufacturers, importers, sellers, consumers and users of products and waste management entities when managing packaging and packaging waste. This Law shall apply to all producers, importers, manufacturers of packaging, sellers, consumers, users of products, and waste management entities. The Act consists of 14 Articles. Article 1 defines objectives of the Law. Article 2 gives definitions of the main concepts. Article 3 establishes priorities in management of packaging and packaging waste. Article 4 establishes essential requirements for packaging. Article 5 marking of packaging. Article 6 record keeping of packaging and packaging waste. Article 7 obligation of the producers and importers to manage packaging and packaging waste. Article 8 determines duty of the sellers to collect packaging and packaging waste. Article 9 determines duty of the consumers. Article 10 classifies organizations. Article 11 regards deposits for packaging. Article 12 establishes liability for non-compliance with this Law. Article 13 regards recommendations to the government. Article 14 establishes the modalities of entry into force of the present Law.
